Court grants businesswoman divorce for lack of peace
A Grade I Area Court in Kubwa, Abuja dissolved a one-year-old marriage between a businesswoman, Nafisat Mohammed and her estranged husband, Salisu Isah on grounds of lack of peace.
The Judge, Mr Yahaya Sheshi dissolved the marriage according to Islamic Law, following Nafisa’s prayer to the court for divorce.
Sheshi had earlier ordered Isah who sent a letter to the court regarding the divorce, to appear in person and prove his claims but he did not honour the invitation
The judge ordered Mohammed to take an oath of affirmation that the dowry paid was N15, 000, since the defendant refused to appear in court.
The judge further ordered the petitioner to refund the said sum for dowry to the court.
Earlier, the petitioner told the court that she married the respondent under Islamic law but had not been in peace with him.
” My life is in danger, the respondent’s wife has threatened me. I pray the court to grant my wish because I am living in fear of the unknown, ” Nafisat said.
In response, the respondent sent a letter to the court due to ill health, through his brother, stating that his marriage to the petitioner lasted from March 30, 2019 to May 28, 2020.
According to him, his family summoned him alongside her parents demanding to know why the petitioner was seen hovering around men she was not related to.
He noted that the petitioner who had left the marriage from January, 2020 shuttling, Abuja and Okene, admitted she did not love him anymore.
The respondent said he wrote a letter to her accepting the termination of the marriage and demanded her to pay N667, 410 for the wedding expense.
He however stated that he had remarried and moved on with his life, adding that the petitioner was in his past and was not threatened in anyway by him.
