Court dismisses theft charge against electrician
A Grade I Area Court Kubwa, on Monday struck out a theft charge against an electrician, Olaniyi Olawuyi, accused of stealing N17, 000 from a tricyclist.
The defendant, whose house address was not given, was charged with theft and mischief which he pleaded not guilty to on Jan.4
The Judge, Malam ahaya Sheshi, struck out the charge following a letter of withdrawal brought before the court by the complainant, Badamosi Ibrahim.
Sheshi said the complainant’s application letter of withdrawal of the case, followed his agreement reached after a conversation with the defendant.
He consequently struck out the case and discharged the defendant of the alleged charge.
Earlier, the Prosecution Counsel, John Okpa told the court that the defendant boarded a tricycle belonging to the complainant, Badamosi Ibrahim on Dec.30.
Okpa alleged that while the complainant disembarked to pray in the mosque, the defendant stole N17, 000 from his tricycle.
He told the court that in his attempt to escape, the defendant allegedly damaged the side mirror of one Ibrahim Attah’s Toyota Corolla car while the stolen money was found in his possession.
The offence, he said contravened the provisions of section 288 of the Penal Code.
