A Federal High Court in Kano, presided over by Justice M. N. Yunusa, has dismissed the Governor-elect of Abia State, Dr. Alex Otti, and all Labour Party (LP) candidates in Abia and Kano States.

The decision of the court to dismiss the governor-elect and invalidate his candidacy for the LP was based on the fact that his nomination did not comply with the 2022 electoral act.

The verdict was rendered in the early hours of May 19th.

In case number FHC/KN/CS/107/2023, filed by Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission, INEC, the court ruled that the process is invalid because the Labour Party failed to submit its membership register to INEC within 30 days prior to their primaries.

The judge ruled, "The party that has not complied with the provisions of the electoral act cannot be said to have a candidate in an election and cannot be declared the winner of an election; accordingly, the votes credited to the first defendant are a wasted vote."
